Article 1: Membership

By participating in dance classes at Rico Latino, members confirm that they are in good physical health and have no medical conditions that could affect their participation in the classes. Members should consult a doctor before starting any new physical activity. Rico Latino is not responsible for health problems or injuries resulting from failure to provide relevant medical information.

Article 2: Liability

Participation in dance classes at Rico Latino is at one's own risk. Rico Latino, its instructors, and staff are not responsible for injuries, accidents, or medical conditions occurring during participation unless such injuries are directly caused by gross negligence on the part of Rico Latino. By signing this contract, the member accepts these risks.

Article 3: Code of Conduct

Rico Latino strives for a respectful, safe, and welcoming environment for all members. Members are expected to treat instructors, staff, and fellow students with respect and to follow the house rules. Inappropriate behavior, harassment, or failure to comply with safety regulations may lead to suspension or termination of membership without refund.

Article 4: Use of Facilities

Members must use the facilities and equipment of Rico Latino as directed by the staff. Damage to property due to improper use is the responsibility of the member, and Rico Latino reserves the right to charge for repair or replacement costs.

Article 5: Dress Code

Members must adhere to the dress code of Rico Latino, including appropriate footwear and clothing specific to the dance style being taught. Rico Latino reserves the right to deny members access to classes if they do not appear in the proper attire or footwear.

Article 6: Cancellation and Schedule Changes

Rico Latino reserves the right to cancel classes or change the schedule due to instructor availability, low attendance, or other unforeseen circumstances. Members will be notified at least 24 hours in advance. In the event of cancellation, the member may participate in a make-up class or receive a class credit. No refunds will be given for cancellations unless no make-up class or credit is available.

Article 7: Late Policy

Members are expected to arrive on time for all classes. Rico Latino reserves the right to deny entry if a member arrives more than 10 minutes late to prevent disruption of the class. Arriving late does not entitle members to credit or refunds.

Article 8: Freezing Membership

Members may request a temporary freeze of their membership for a minimum duration of 1 month and a maximum duration of 3 months per calendar year. This can only occur when it has been approved in writing by an administrative staff member. Requests must be submitted in writing at least 7 days before the intended start date. No payments will be processed during the freeze, and the member will not have access to classes. The membership will automatically resume after the freeze period.

Article 9: Children and Parental Consent

For participants under the age of 18, consent from a parent or guardian is required. Parents or guardians are responsible for ensuring that children follow the instructor's instructions and behave appropriately. Rico Latino reserves the right to ask parents to remove their children from the premises if they are disruptive or pose a safety risk.

Article 10: Media Consent

From time to time, Rico Latino may take photos or videos during classes for promotional purposes, such as use on social media or on our website. By participating in classes, members give consent for their image to be used for these purposes. Members who do not wish to be photographed or recorded must inform the instructor at the beginning of the class.

Article 11: Processing of Personal Data (GDPR)

Rico Latino places great importance on the protection of your personal data. We process personal data in accordance with the General Data Protection Regulation (GDPR). The following data is processed:

• Name
• Address
• Gender
• Date of Birth
• Email Address
• Phone Number
• Profile Photo

This data is necessary to provide our services effectively. By becoming a member of Rico Latino, you consent to the processing of this data. For more information on how we handle personal data, please consult our Privacy Policy.

Article 12: Indexing of Rates

Rico Latino reserves the right to index membership fees annually with a maximum increase of 5%.

Article 13: Direct Debit and Chargebacks

The membership fee must be paid by the member via direct debit prior to each month. If a direct debit is charged back, Rico Latino has the right to charge €10 in administration costs for re-collecting the amount. In the case of overdue payments, the member is also liable for extrajudicial collection costs and statutory interest in addition to the outstanding amount.

Article 14: Complaints Procedure

Complaints regarding the services of Rico Latino must be submitted in writing within 14 days of delivery. Submitting a complaint does not suspend the payment obligation. If a complaint is not reported in a timely manner, the right to repair, replacement, or compensation is forfeited.

Article 15: Cancellation of Membership

If the member does not terminate their membership in writing at least 1 month before the end of the contract term, the membership will automatically renew for an indefinite period, with a notice period of 1 month. Early termination is only possible on medical grounds with a doctor's note or if relocating outside a radius of 20 kilometers from Rico Latino. No refunds will be granted.

Article 16: Other Provisions

• The membership is strictly personal and cannot be transferred without consultation.
• Rico Latino reserves the right to ask members for identification upon registration.
• Rico Latino is not liable for loss or damage to personal belongings.
• The house rules of Rico Latino apply at all times and are available on-site.
• Rico Latino may refuse access to the premises without providing a reason.
